Outlet Backyard Ultra Event — Terms, Conditions & Entrant Waiver. Please read this document carefully before completing your registration. By submitting your registration & electronically acknowledging this waiver, you agree to be bound by all terms & conditions set out below.

“Event” in the following waiver declaration is known as “Outlet Backyard Ultra Event” 

By entering the Outlet Backyard Ultra Event you acknowledge & agree to the following.

I hereby acknowledge this Event is run on outdoor trails & potentially short segments of public road. That there are many hazards & not limited to: Trip hazards such as rocks, uneven ground, & tree roots. I acknowledge other human & vehicular hazards such as other track users on foot, on bike or vehicle & of adverse weather conditions changing the condition of the track & effecting the conditions of natural environment during the Event. I acknowledge that I myself could become a hazard for other entrants, race officials & other track users.  

I acknowledge that there are risks involved with participation in this Event & am fully aware of the dangers participating in an Event such as a Backyard Ultra & fully assume the risks associated with my participation & wellbeing of myself & other entrants & race officials during the Event – I enter this Event at my own risk. 

I hereby attest & verify that I am medically & physically fit, have no known medical condition, injury or illness that would make it unsafe for me or other entrants to participate. That I have trained sufficiently for an endurance running event & I have not been advised otherwise by a qualified medical person.

I agree that if I have any existing medical conditions, I will obtain written clearance from a qualified medical practitioner prior to the Event &, if requested, provide this to the Organisers.

I agree to carry any required personal medication (including but not limited to EpiPens, insulin, or inhalers) on my person during the Event.

I acknowledge that the Organisers of this Event are not responsible for assessing or monitoring my individual medical fitness to participate.

I acknowledge that participation in an endurance running event carries inherent risks, & I fully understand & accept those risks. I acknowledge the character of this Event provides health hazards & risks including but not limited to cardiovascular stress, musculoskeletal injury, hyponatremia, dehydration, heat-related illness, hypothermia, impaired judgement due to fatigue or sleep deprivation, & in extreme cases serious injury or death & voluntarily assume all risks associated with my participation in this Event. 

I confirm that I have provided accurate emergency contact details as part of my registration & I authorise Event officials to contact my nominated emergency contact in the event of a medical emergency or serious incident.

I consent to receiving urgent medical treatment as may be reasonably necessary in the event of illness or injury suffered during the Event, including transportation to a medical facility if required.

I understand & agree that situations may arise during the Event, or other “acts of god” which may be beyond the immediate control of officials or organisers that may force changes or cancellation & I will continually participate in a manner that does not endanger either myself or others.

Event Organisers reserve the right to implement a contingency plan in the interests of safety but will not be held liable for any loss as a result of such a decision. If conditions are deemed to be unsafe due to extreme inclement weather or other unforeseen events that my entry fee will be entirely non-refundable & will be transferred to the following year. 

Event organisers reserve the right to alter rules, regulations & Event course at any time provided entrants are advised prior to the Event, or if change is in the interest of competitor safety.

I agree to comply with the rules & directions of event officials & their personnel.

I understand that I must not leave the course or event area without first notifying officials as soon as possible, regardless of the reason for withdrawal.

I agree to at all times obey the instructions of Race Officials including safety directions & signage & beware of hazards & vehicular transport if the course should divert to or through public roads. I understand that if I fail to obey the instructions of Race officials I will be removed from the Event & disqualified. The race director has the discretion to disqualify competitors.

I agree to treat fellow entrants, Event officials, volunteers, landowners, & members of the public with courtesy & respect, & conduct myself in a decent manner. I won’t be a dick. If someone is in need of help due to an emergency I will stop & assist & send word for help. 

I understand that any entrant who fails to comply with Event rules, regulations, or the reasonable instructions of officials may be removed from the Event & disqualified at the discretion of the Race Director. The Race Director’s decision is final.

By my participation in this Event, I acknowledge neither organisers, sponsors stakeholders, volunteers, venue providers nor other parties associated with the Event shall have any responsibility, financial or otherwise, for any risk incident that might arise, whether or not by negligence, from any direct or indirect loss, injury or death that might be sustained by me or any other party directly or indirectly associated with me, from my intended or actual participation in the Event or its related activities. 

Upon registration & payment of my entry fee, I hereby & on behalf of my heirs, executors, administrators & assignees release & forever discharge the organisers, sponsors, landowners & any and all persons involved in the conduct of the Event from any & all liability whatsoever or claims of damages or actions whatsoever (including negligence) in any manner arising out of my participation in the Event.

Nothing in this waiver excludes or limits any liability that cannot be excluded or limited under the Consumer Guarantees Act, the Fair Trading Act, or any other applicable New Zealand law.

Participants under the age of 12 must be accompanied by a parent, legal guardian, or responsible adult at all times during their participation in the Event & while on the event site. Accompanying adult accepts full responsibility for supervision & wellbeing of the Participant at all times.

Any Participant under 18 must have this waiver completed & electronically acknowledged by a parent or legal guardian prior to registration being accepted. By doing so, the parent or guardian confirms they have read & agree to all terms contained in this waiver on behalf of the Participant.

By registering, the entrant (or their parent/guardian where applicable) confirms age requirements & supervision obligations set out above will be met.

I hereby consent to organisers or suppliers filming me & allow the use of my name & image or voice or likeness to be used in the media & for marketing purposes by the Event or sponsors or for promotional, marketing, or media purposes, including on social media platforms, without further notice or compensation. I understand that I may withdraw this consent at any time by notifying the Organisers in writing, & that withdrawal will not affect any use already made prior to the date of withdrawal.

I accept that my details will be added to the Event database & Backyard Ultra affiliated event databases to ensure national & age records are kept up to date & publicly available. 

I understand that I have rights under the Privacy Act to access & correct any information held about me.

I also understand that I may be contacted via email by Outlet Backyard Ultra regarding this upcoming Event & future promotions. 

I acknowledge that I have read & understood the course information available on the website & will update my knowledge of the course before Event day, including the rules.

I acknowledge that I have read & understand the Event’s refund & cancellation policy found on the website & at the bottom of this page. 

This waiver & all matters relating to my participation in the Event are governed by the laws of New Zealand. 

By completing registration & checking the box below, I confirm that:

• I have read & understood this waiver in full;

• I agree to be bound by all terms & conditions set out above;

• I am either 18 years of age or older, or I am the parent or legal guardian of the Entrant named in this registration & I am signing on their behalf; &

• I understand that this electronic acknowledgement has the same legal effect as a handwritten signature.

You will receive an email confirmation of your Event registration immediately following payment from the Event Plus registration system.

Payments for this Event are managed by EventPlus. 

All prices are in NZ Dollars. 

For payments made via Credit Card, the name which will appear on your bank statement will be BACKYARDULTRAWĀNAKA.NZ 

Refunds of 75% are possible at any time due to pregnancy or serious illness. 

Entries cancelled up to 4 weeks of the Event will receive 75% refund.

Entries cancelled from 2 weeks to 4 weeks before the Event have a 50% refund.

Entries cancelled less than 2 weeks before the Event will receive no refund. 

There are no transfers to other runners. 

If this event is cancelled due to circumstances outside of Event organisers control over 1 month before event date entrants will be offered a 75% refund.

If the Event is cancelled less than 1 month before the Event date entrants will be offered a 50% refund or entry into the following year’s Outlet Backyard Ultra.
